The Yakima County Prosecuting Attorney’s Office has three openings for attorneys with experience in one or more of the following areas:

Position 1 - Civil Division – Hiring Range $70,552 to $99,641 (Attorney II/III/IV)

This position is responsible for providing comprehensive, expert legal advice to County elected officials, department heads and employees in civil matters including but not limited to: General Municipal law; contract law (public procurement, liability, construction); tort defense; eminent domain, land use law (growth management, permitting, building and fire codes); code enforcement; constitutional law; real estate (purchase and sale, leases, easements); environmental law; public works law (roads, solid waste, stormwater facilities, flood control); utilities. The incumbent will represent County officials and government in liability claims and complaints including tort, personnel matters and administrative proceedings and will provide representation in civil litigation arising from complaints and claims. Will draft and review ordinances, resolutions and contracts and provide legal advice and training regarding questions about or changes in the law affecting County operations. Performs case evaluation, investigation, trial preparation, witness interviews and depositions as well as settlement negotiations, pre-trial motions, trials and appeals as required. May be required to participate in and/or prepare and present in-house training or educational programs to local community or civic organizations. This position has extensive interaction on the Prosecutor’s behalf with other county and state agencies.

Position 2 / 3 - District Court or Felony Division – Hiring Range $63,320 to $70,552 (Attorney I/II)

These positions evaluate cases and assess factual and legal sufficiency under the law at each stage of a criminal proceeding. Incumbent reviews police and other reports and analyzes all information available. Makes charging decisions regarding legal and factual sufficiency for filing of a case. Evaluates strengths, weaknesses and facts of each case for purposes of additional investigation, plea negotiations, development of case strategy and trial preparation. Coordinates or conducts case investigation for trial preparation as necessary and arranges for tests of physical evidence, testimony of expert witnesses and interviews of witnesses as required. Incumbent will instigate or respond to plea bargaining negotiations with opposing counsel and represents the interest of the state.

Represents the state at preliminary appearances, arraignments, pre-trial motions, pleas of guilty, sentencing hearings and post-trial matters such as restitution hearings and sentence reviews/amendments. Conducts all trial actions including: selection of jury, opening arguments, direct and cross examination, introduction of evidence and exhibits, preparation of jury instructions, closing arguments and post-trial motions.

Education and Experience: Requires current admission to the Washington State Bar Association and a member in good standing. Hiring range is based upon directly related experience; the Attorney II requires 4 years of experience, the Attorney III - 8 years, and the Attorney IV – 12 years.
